Terms of Service
These are the Rise From The Ashes Podcast terms of service. The show is hosted by Baz Porter® on the C-Suite Network podcast. They explain how to nominate a podcast guest, how booking works, and what the guest spot covers.
- Podcast guest terms: nominating is free, and invited nominees are invited for free.
- Podcast guest spot terms: a $149 podcast guest spot, charged when you book. It is a non-refundable guest spot.
- Podcast guest booking terms: pick a time on the calendar, then complete the short show prep form.
1. Agreement to Our Legal Terms
These Terms of Service ("Terms") are a binding agreement between you and Baz Porter LLC, a Colorado limited liability company ("Company," "we," "us," or "our"), at 1630 30th Street, Ste A-418, Boulder, CO 80301. They govern your use of risefromtheashespodcast.com, the Rise From The Ashes podcast (the "Show"), and every related page, form, calendar, and service (together, the "Services").
By using the Services you agree to these Terms. If you do not agree, do not use the Services.
We may change these Terms. When we do, we update the "Last updated" date above. Continued use after a change means you accept it.
2. Precedence of Signed Agreements
If you and Baz Porter LLC have signed a separate written agreement, that agreement controls where it conflicts with these Terms. These Terms fill any gap it leaves.
3. Our Services
Rise From The Ashes is a podcast of real stories of falling and rebuilding, hosted by Baz Porter® on the C-Suite Network. The Services let you learn about the Show, nominate a guest, apply to be a guest, book a recording time, and contact us.
The Show is education and storytelling. It is not medical, mental-health, legal, financial, or tax advice, and no episode creates a counsel relationship or promises any result. Speak with a licensed professional before acting on anything you hear.
The Services are for people 18 or older. They are not built for any place where their use would break local law. If you use them from such a place, you do so on your own initiative and are responsible for following local law.
4. Intellectual Property Rights
We own or license the Services, including the Show, episodes, audio, video, text, designs, graphics, logos, and marks (together, the "Content" and the "Marks"). They are protected by copyright, trademark, and other law.
Baz Porter® is a registered trademark of Baz Porter (U.S. Trademark No. 97468218). The Prestige Architect™ is a trademark of Baz Porter. Other names on the Services belong to their owners.
We give you a limited, non-exclusive, non-transferable, revocable license to view the Services and listen to or watch episodes for your own personal, non-commercial use. You may not copy, sell, rebroadcast, scrape, or build a product from the Content without our written permission. Share links to episodes freely. Short quotes with credit and a link back are welcome.
Your story stays yours. If you are a guest, you keep ownership of what you say and any materials you give us. The license you grant us is in Section 8. We keep ownership of the episode as a produced work and all of the Marks.
To ask for permission outside this license, write to [email protected] or use the Contact page.
5. Guest Spot: $149, Charged at Booking, Non-Refundable
Guest spot $149. One investment, charged when you book. It is non-refundable.
The guest spot is an episode on the Rise From The Ashes Podcast. You pick a recording time on the calendar. The $149 is charged at that moment, at the time of booking. It is a one-time investment. It is not a subscription, it has no minimum term, and it does not renew.
What your investment covers. The $149 covers making your episode and getting it onto the players where the show already lives. It does not promise a number of listeners, leads, or sales. It gives your story a real stage.
- A recorded conversation with Baz Porter®, in your own words.
- Your episode, produced and published by us.
- Placement on the players where the Show lives: Apple Podcasts, Spotify, YouTube, and iHeartRadio.
- Prep. After you book, you complete a short show prep form so you arrive ready.
Because the investment is charged at booking and is non-refundable, book only when you are ready to record. If we cancel or cannot hold your recording, we will rebook you at no added investment. Section 7 explains how rescheduling works.
Your card or other method is handled by our booking and billing providers. We do not store full card numbers. You agree to give accurate billing information. If a charge fails, the booking is not confirmed.
Nothing in this section limits rights you have under law that cannot be waived.
6. Nominating a Guest
Anyone may nominate a person for the Show. Nominating is free. A nominee who is invited is invited for free.
When you nominate someone, you confirm that you have told them, and that they are happy for us to contact them. You give us only the contact details you have a good reason to share. We use a nominee's details only to consider and send an invitation, as our Privacy Policy describes.
A nomination is not a promise of an invitation. We choose who we invite. An invitation is not a promise of an episode. If an invited person decides to record, they choose a time on the calendar, and the guest spot terms in Section 5 apply: $149, charged when they book, non-refundable.
7. Booking, Scheduling, and Airing
Booking is complete when you pick a time and the $149 is charged. You will get a confirmation. Then you complete the show prep form.
Life happens. If you need to move your recording, tell us at least 48 hours before your time and we will rebook you once at no added investment. If you miss your time without notice, or cannot be rebooked, the investment is not refunded.
We produce and edit the episode. We decide the final edit, title, artwork, description, and release date. We will do our best to publish within a reasonable time after recording, but we do not promise a date. We may decline to publish an episode, or take one down, if it breaks these Terms, the law, or the standards of the Show or its distribution partners. We do not promise any episode will air.
8. Recording, Consent, and Release
By recording with us you consent to being recorded in audio and video. You agree that we may edit, produce, publish, distribute, and promote the episode and clips from it on the Show, our sites, social channels, and third-party podcast and video platforms, anywhere in the world, for as long as the Show exists.
You give us permission to use your name, voice, likeness, biography, and the materials you provide, in connection with the episode and its promotion. You are not owed any further investment for these uses.
You agree not to share anything you do not have the right to share, including other people's private information. If you want something left out, tell us before the episode publishes, and we will review it. We decide the final edit.
Your episode may be public for a long time. Once an episode is published, copies and clips may live on platforms we do not control. We cannot guarantee full removal from those platforms.
9. Your Representations
By using the Services you represent that: (1) the information you give us is true, accurate, and current; (2) you will keep it current; (3) you are 18 or older and able to agree to these Terms; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use will not break any law.
If you give us false or inaccurate information, we may suspend or end your access and any booking.
10. Prohibited Activities
You may use the Services only for the purposes we offer them. You agree not to:
- Scrape, harvest, or systematically pull data or content from the Services.
- Trick, defraud, or mislead us or other users, especially to learn private information.
- Get around, disable, or interfere with security features of the Services.
- Use the Services to harass, abuse, threaten, or harm any person.
- Use the Services to compete with us, or to sell or resell access to them.
- Upload or send viruses, malware, or any code that interferes with the Services.
- Use automated tools, bots, or scripts to submit forms or bookings.
- Pose as another person, or nominate someone to harass or mislead them.
- Copy, adapt, reverse engineer, or decompile any part of the Services, except as law allows.
- Use the Services in a way that breaks any law or regulation.
11. Your Submissions and Contributions
The Services may let you send us nominations, form entries, prep answers, messages, and other material ("Contributions"). Contributions are not confidential unless we agree in writing, and our Privacy Policy covers personal information in them.
You keep ownership of your Contributions. You give us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display them as needed to run the Services, to consider your nomination or application, to produce your episode if you record, and to promote the Show. You promise that you own or have the rights to your Contributions and that they do not break the law or anyone's rights.
We may remove any Contribution that breaks these Terms.
12. Third-Party Platforms and the C-Suite Network
The Show is hosted by Baz Porter® on the C-Suite Network. The Services link to or rely on third-party sites, calendars, forms, billing, and podcast and video platforms. We do not control them, and their terms and privacy practices apply when you use them.
We are not responsible for third-party content, availability, or policies. A link is not an endorsement. If you buy or sign up with a third party, that is between you and them.
13. Services Management
We may monitor the Services for violations, take action against anyone who breaks these Terms, refuse or restrict access, remove content, and manage the Services to protect our rights and property and the Services themselves.
14. Privacy Policy
Our Privacy Policy explains how we handle personal information. By using the Services you agree to it. The Services are run in the United States. If you use them from elsewhere, you agree your information may be moved to and handled in the United States.
15. Term and Termination
These Terms stay in effect while you use the Services. We may deny access to the Services, and end or suspend any use or booking, at our discretion and without notice, for any reason or none, including for a breach of these Terms or the law.
If we end a booking because we cannot record your episode, Section 7 explains rebooking. If we end it because you broke these Terms, the investment is not refunded. If we end your access, you may not register or use the Services again under any name.
16. Modifications and Interruptions
We may change, pause, or remove any part of the Services at any time, without notice. We have no duty to keep information current. We are not liable to you or anyone for a change, pause, or end of the Services. We cannot promise the Services will always be available. We may have outages, maintenance, or errors, and we may change or end the Services at any time.
17. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. This is the case even if you live somewhere else.
18. Dispute Resolution
Informal negotiation. To speed up and lower the cost of any dispute, claim, or controversy about these Terms or the Services (a "Dispute"), you and we (each a "Party," together the "Parties") agree to first try to settle it informally for at least 30 days. The 30 days start when one Party gives the other written notice. Send yours to [email protected].
Binding arbitration. If the Parties cannot settle a Dispute in 30 days, it will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. The place of arbitration is Boulder County, Colorado. The language is English. The arbitrator's decision is final and may be entered in any court that has authority.
Individual claims only. The Parties may bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not combine claims. If this class waiver is found unenforceable, the arbitration agreement does not apply to the claim it covers.
Time limit. Any claim must be filed within one (1) year after it arose, or it is permanently barred.
Exceptions. Either Party may go to court for (a) a claim to protect or enforce intellectual property rights, (b) a claim of fraud or theft, or (c) injunctive relief. Small claims court is also open to either Party.
19. Corrections
The Services may contain typos, errors, or missing information, including about pricing and availability. We may fix them and update the Services at any time, without notice.
20. Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WILL NOT EXCEED THE AMOUNT YOU INVESTED WITH US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE. Some places do not allow these limits, so they may not apply to you.
22. Indemnification
You agree to defend, indemnify, and hold us harmless, including our members, officers, and agents, from any loss, damage, claim, or demand, including reasonable attorney fees, made by a third party because of: (1) your Contributions; (2) your use of the Services; (3) your breach of these Terms; (4) your breach of a promise you made here; or (5) any harmful act toward another person through the Services. We may take over the defense of any matter, at your cost, and you agree to help.
23. User Data
We keep certain data you send through the Services to run them. You are responsible for the data you send. We do not promise it will never be lost or corrupted, and we are not liable for any loss of it.
24. Electronic Communications, Transactions, and Signatures
Visiting the Services, sending us forms and emails, and booking are electronic communications. You agree to get notices, agreements, and records from us electronically, and that they satisfy any legal need for a writing. You agree to the use of electronic signatures and records in transactions with us.
25. Miscellaneous
These Terms, with our Privacy Policy and any posted rules, are the entire agreement between you and us about the Services. If we do not enforce a right, that is not a waiver. If a part is found unenforceable, the rest stays in force. You may not assign these Terms. We may assign ours. No joint venture, partnership, employment, or agency relationship is created by these Terms or your use of the Services. These Terms are not read against us because we wrote them.
